5131.62 Tobacco/Smoke Free Schools

 San Bernardino County Superintendent of Schools prohibits student’s possession, use of tobacco and any products containing tobacco or nicotine on any County property, while attending school-sponsored activities, or while under the supervision and control of County employees. Students who violate this prohibition may be subject to suspension or expulsion. (Education Code 48900 and 48901)

Under 48900(h), prohibited products include, but not limited to, cigarettes, cigars, miniature cigars, clove cigarettes, smokeless tobacco, snuff, chew packets, and betel. This also includes the possession, sale, furnishing, and/or use of electronic cigarettes, or related substances (included but not limited to liquids and oils) used in electronic cigarettes, or smokeless non-tobacco cigarettes; also known as an e-cigarette, personal vaporizer or PV, e-hookah, or any form of electronic inhaler that vaporizes a liquid/oil solution into an aerosol mist and/or vapor, whether it contains nicotine or not is not allowed. However, this section does not prohibit the use or possession by a pupil of his or her own prescription products.
