5100 - Release of Students

Students shall be released only to the parent or legal guardian, except as provided below:

  1. Students may be released to other specified persons provided that such arrangements have been made and agreed upon by the parent/guardian and the principal/designee and documented.
  2. Students may be released to law enforcement officers at the point at which the officer assumes official jurisdiction over the student in the course of an investigation.
    1. The principal shall be present at all interviews between students and law enforcement officers.
    2. If the law enforcement officer is to take a student to a police station, juvenile hall or other law enforcement site, the principal shall take immediate steps to notify the parent, legal guardian or other designated responsible person of the release of the student to such officer and of the place to which the student is reportedly being taken.
  3. Students on probation may be released to their assigned probation officers.
    1. Probation officers shall be permitted to interview their probationers at school without the principal being present.
    2. If the probation officer is to take a student to a police station, juvenile hall or other law enforcement site, the principal shall take immediate steps to notify the parent, legal guardian or other designated responsible person of the release of the student to such officer and of the place to which the student is reportedly being taken.
  4. Before releasing a student to any person authorized above, the principal, and/or teacher, shall ascertain to his/her satisfaction that the individual calling for the person is in fact the authorized person as represented.
  5. Whenever a student is taken from school by any person authorized by this regulation, arrangements for the student’s release shall be made through the office of the principal when the program is located on a regular school site.
