4111.2, 4211.2, 4311.2 - Affirmative Action Resolution

WHEREAS, Title VII and Title IX of the Civil Rights Act of 1964 prohibit job discrimination because of on the basis of the person's actual or perceived race, religious creed, color, national origin, ancestry, age, marital status, pregnancy, physical or mental disability, medical condition, genetic information, veteran status, gender, gender identity, gender expression, sex, or sexual orientation.

WHEREAS, the Equal Employment Act of 1972 extended Title VII coverage to public school districts and agencies; and

WHEREAS, Title V of the California Administrative Code requires that school districts and school agencies develop Affirmative Action Employment procedures; and

WHEREAS, Title 41, Code of Federal Regulation, Chapter 60, requires that local governmental agencies require proof of compliance of both construction and non-construction contractors for transaction in excess of $10,000, for federally-assisted contracts; now therefore,

BE IT RESOLVED that employment and procurement in every school and department within the San Bernardino County Superintendent’s Office be on a totally fair and impartial basis, and that no factors of on the basis of the person's actual or perceived race, religious creed, color, national origin, ancestry, age, marital status, pregnancy, physical or mental disability, medical condition, genetic information, veteran status, gender, gender identity, gender expression, sex, or sexual orientation are to be considered.

BE IT FURTHER RESOLVED that the branch heads shall be charged with the responsibilities of implementing this policy through the administration of an aggressive Affirmative Action plan.
