4012 - Conditions of Employment

Certain conditions of employment are necessary for either initial employment or continued employment, as well as for promotions. Included in these conditions are: initial employment, medical examinations, periodic medical examinations, tuberculosis examinations, fingerprint requirements, work year schedule and certification/registration and/or renewal of credential. 

Initial Employment 

In order for a person to be recognized as being an employee of the County Superintendent of Schools the person must first be approved for employment by the County Superintendent of Schools, who is the employer of record. Employment occurs when the County Superintendent of Schools approves/ratifies the Personnel Ratification list and the person receives an offer of employment letter signed by the County Superintendent of Schools. 

Medical Examination 

The County Superintendent of Schools may require a medical examination, by a certified medical specialist selected by the County Superintendent of Schools, as a condition of employment, promotion, or continued employment. Cost of such examination shall be at the expense of the County Superintendent of Schools Office. 

Periodic Medical Examinations 

The County Superintendent of Schools reserves the right to require periodic medical examinations by a certified medical specialist selected by the County Superintendent of Schools in order to determine that the employee is free from communicable diseases which render the employee unfit to instruct or associate with children or perform the duties of his/her position. 

Tuberculosis Assessment/Examination 

Except as provided by the Education Code, no person shall be initially employed in a certificated or classified position unless the person has submitted to an assessment and/or examination within the past 60 days to determine that he/she is free from active tuberculosis. 


Pursuant to Education Code requirements, all employees in certificated or classified positions shall, as a condition of continued employment, be required to present evidence once every four ( 4) years that they are free from active tuberculosis. The responsibility for presenting such evidence rests with the employee. The County Superintendent of Schools Office shall bear the cost of such examination.

Fingerprint Requirement 

No person shall be initially employed in a classified position unless the person has been cleared via Live Scan Human Resources or a public law enforcement agency. 

Work Year Schedule and Conditions 

A calendar shall be established each year to show the number of work days and holidays for each employee. 
The County Superintendent of Schools shall establish work schedules, provisions for absences and other conditions of work in keeping with the California Education Code, policies of the County Board of Education and provisions incorporated in current employer-employee collective bargaining agreements. 

Certification/Registration and/or Renewal of Credential 

If the employee is employed in a position that requires a valid credential, the employee is required to file the credential with the San Bernardino County Superintendent of Schools Office and not allow the credential to expire in order for the employee to be paid for services rendered. It is the obligation of the employee to insure the appropriate credential is current and valid.
