3541.3 - Video/Audio Surveillance on School Busses
The San Bernardino County Superintendent of Schools (SBCSS) recognizes the importance of maintaining an environment on school buses that protects the health, safety and welfare of all passengers on school buses. In an effort to pursue these goals, video/audio surveillance equipment may be utilized on school buses.
Pursuant to California Highway Patrol Vehicle Code 26708 (section 13A through 13F) the County Superintendent has established the following policy.
- The County uperintendent or his/her designee will ensure there is a sign prominently displayed on the school bus informing occupants that such video and audio recordings are occurring.
- Per California Highway Patrol Vehicle Code 26708 data recorded to the device is the property of the registered owner or lessee of the vehicle.
- All recordings shall be maintained for a period of 90 days, unless the County Superintendent determines that the recording is relevant to a safety or disciplinary proceeding. The period may be extended in via subpoena received prior to the 90 day expiration date.
- Recordings may be viewed only after expressly authorized by the Superintendent:
- Superintendent or designee
- Business Services Director
- Program Manager, MOT
- Transportation Manager
- SELPA Administrator or designee
- Area Director
- District Superintendent
- District Special Education Director
- Principal
- Risk Management Services
- Law Enforcement Officers
- Transportation Contractor Supervisor or designee
Parents of a student that have concerns regarding a bus incident or as part of a safety or disciplinary proceeding will be permitted to view and listen to the recording. No other individuals shall be entitled to view or listen to the recording without express written authorization of the County Superintendent.
